SUBCLASS 309 VISA
(PARTNER PROVISIONAL VISA)
The Subclass 309 visa allows an Australian citizen,
permanent resident, or eligible New Zealand citizen to temporarily reside in
Australia with their spouse or de facto partner. This visa serves as a stepping
stone towards obtaining a permanent Partner Visa (Subclass 100). The applicant
must be in a genuine relationship with their partner in Australia when applying
for the visa and must be outside of Australia during the application process.
This is a temporary visa, which can lead to a permanent visa later on.
The Subclass 309 visa holder can:
Travel to and from Australia as many times as needed
With the Subclass 309 visa, you can take as many hours of
English classes as needed to reach vocational level, even if you have already
completed 510 hours. You also have access to Australia's public healthcare
program, Medicare. Additionally, your dependents, including children, can be
included in the application, given they pass the required health and character
assessments.
Duration of stay:
The Subclass 309 visa allows for temporary stay in Australia
as a partner or spouse of an Australian citizen or permanent resident, or a
qualified New Zealand citizen. The length of stay typically ranges from 15 to
24 months, and a decision on the permanent Partner (Migrant) visa (subclass
100) will determine further stay or if the application is withdrawn.
AUSTRALIA PARTNER
VISA (SUBCLASS 100)
To be eligible for the Subclass 309 Partner visa, you and
your partner must have a genuine relationship. This is a temporary visa that
must be applied for from outside Australia and is a step towards the permanent
Subclass 100 Partner (Migrant) visa.
The processing time for this visa is uncertain and depends
on various factors such as completing the application form correctly, providing
prompt responses to queries, and verifying the information provided. The
expected duration of stay is typically between 15 to 24 months.

DEPENDENTS:
To bring your family to Australia while studying, you can
either include them in your initial student visa application or apply for their
visas once you have begun your studies. Eligible family members include
spouses, partners, and children under 18 who are unmarried.
If including them in your initial application, their details
must be included in Form 157A, and the main student visa holder must have at
least 12 months of validity and enough funds and insurance to cover all
expenses for that period.
If applying after starting studies, the required documents
must be submitted.

101

CONTRIBUTORY PARENT CATEGORY:
The Sponsored Parent (Temporary) Visa (Subclass 870) was
introduced in 2003 to make it easier for parents to migrate to Australia.
However, the visa application fee is higher for this visa and applicants must
provide an Assurance of Support and a bond. This visa grants the holder the
ability to live in Australia indefinitely, access the country's public health
care system, sponsor a relative's visit, be eligible for citizenship, and
travel to and from Australia for five years from the date of grant.
Parent visas are a category of visas that allow parents to
stay in Australia on a temporary basis for three or five years. Those holding
this visa can apply for additional visas to extend their stay up to ten years
but they cannot work while they are in Australia. To be eligible for a parent
visa, the applicant's child must be an Australian citizen, permanent resident
or an eligible New Zealand citizen. The child must have lived in Australia
legally for at least two years. The applicant must have a sponsor and pass the
balance of family test. They must also be in good health and of good character.
